- Abstract
This study aims to identify and describe the implementation of the protection of migrant workers’ children’s rights based on international conventions and positive law in Indonesia. Migrant workers’ children are those children left behind by one or both parents who work abroad for the sake of their family’s welfare. In their daily lives, they face challenges in accessing education, healthcare services, and social support. The legal protection of migrant workers’ children is regulated by the Convention on the Rights of the Child and Law No. 35 of 2014 concerning amendments to Law No. 23 of 2002 on child protection. This study focuses on the implementation of policies by the government and related institutions regarding the protection of migrant workers’ children. The often-ineffective implementation creates a gap between policy and field practice, while weak law enforcement hinders the protection that should be provided. The lack of coordination between institutions and bodies that protect the rights of migrant child workers. Policies are not well integrated, leading to overlaps or even gaps in protection.
