Abstract

This study aims to analyze the effectiveness of the Public Prosecution Service’s role in the process of calculating state losses as an important part of law enforcement efforts against corruption in Indonesia. The main focus of this study is to determine the extent of the involvement of the Public Prosecution Service in determining the amount of state losses can contribute to the success of prosecuting corruption cases, both in the investigation, prosecution, and court decision stages. This study uses a normative legal approach by examining relevant laws and regulations as well as case studies of several court decisions on corruption crimes. The results of the study indicate that the active involvement of the Public Prosecution Service in calculating state losses, which is typically carried out in conjunction with the BPK (The Audit Board of Indonesia) or BPKP (Financial and Development Supervisory Board), can enhance the accuracy and validity of evidence in the legal process. However, several obstacles were also identified, such as the lack of competent human resources in the field of forensic audits, and suboptimal coordination among law enforcement officers. This effectiveness is a key factor in determining the success of the prosecution, especially in proving the element of state loss which is an essential element in proving corruption cases. Therefore, it is necessary to strengthen the technical capacity within the Public Prosecution Service and increase synergy between institutions so that the law enforcement process against corruption becomes more optimal and just.
