Abstract

In the present era, when the artificial intelligence is developing rapidly, it brings a lot of conveniences to people’s daily lives. Among all many functions of AI uses in the arts, the creation of music, poems, and paintings, these systems can generate new images by using generative models. Artificial intelligence is capable of producing novel and creative content in a variety of formats, and the production’s quality can even rival that of works created by human artists. However, as the application of generative AI tools becomes more widespread, more and more stakeholders have expressed concerns about the potential impact of AI-generated technologies on copyrights. For some, they believe that AI undermines the ability of rights holders to receive the recognition and compensation they deserve. The most concerning issue is the free use of copyrighted works in the development of AI. During the training and generation of creative works, AI might infringe on the copyrights of existing works’ authors. This thesis discusses the issue about copyright infringement in AI-generated artworks. Within the framework of U.S. law, the intellectual property issues surrounding AI in the training generation of images require a comprehensive assessment that integrates core principles of copyright law with judicial practices.
