- Abstract
This study examines the institutional relationship between the state and indigenous communities in the implementation of legal protection for Communal Intellectual Property (Kekayaan Intelektual Komunal / KIK) through the National KIK Data Center (Pusat Data Nasional KIK / PDN KIK). The recording of KIK in the PDN KIK is interpreted as a form of state recognition of the existence of traditional knowledge and traditional cultural expressions. However, structurally, the state retains primary control in determining the validity, classification, and regulation of KIK data. To analyze the dynamics of recognition and control in the state’s institutional pattern for protecting Communal Intellectual Property through the National Data Center. This research employs a socio-legal approach using a literature review method. The analysis focuses on key legal instruments, including Law No. 28 of 2014 concerning Copyright, Minister of Law and Human Rights Regulation No. 13 of 2017 concerning Communal Intellectual Property Data, and Government Regulation No. 56 of 2022 concerning Communal Intellectual Property. The study reveals that the current KIK recording mechanism is centralized (top-down) and has not substantially involved indigenous communities. The legal protection framework remains defensive, emphasizing registration and documentation rather than ensuring benefit sharing or remedies for violations. This reflects a state ambivalence—balancing between efforts to recognize indigenous rights and tendencies to maintain administrative control. The institutional design of Communal Intellectual Property protection in Indonesia remains state-centric, with limited participation from indigenous communities. A participatory institutional reform aligned with indigenous legal systems is needed to achieve fair, inclusive, and sustainable protection of communal intellectual property.
