Abstract

The rapid and constructive growth of e-commerce in India which has revolutionized consumer transactions, but at the same time also presented inevitable challenges in dispute resolution concerned with e-commerce. We know that traditional litigation is unsuitable for high-volume disputes in online markets due to delays, high costs, unreliability and limited accessibility. Online Dispute Resolution (ODR) has emerged as a specific solution that integrating technology with existing ADR tools and methods like negotiation, mediation, and arbitration. This study evaluates India’s progress and challenges in this area, focusing on issues of regulatory standardization, enforceability of outcomes, digital literacy gaps and most important “accessibility to justice.” The paper evaluates the extent to which ODR mechanisms uphold the principles of fairness, transparency, and accessibility under digital justice. The findings aim to inform policymakers, legal practitioners, and stakeholder of the society on strengthening ODR frameworks to enhance consumer trust and reliability and to ensure equitable dispute resolution in India’s digital marketplace.
